ELKO – A man was who is accused of a 2015 sexual assault claimed his tight pants prevented the possibility of intercourse.
Daniel C. Goerdt Jr., 28, of Elko was arrested Friday at the Elko County Jail for sexual assault.
According to Sgt. Mike Palhegyi, the victim claimed that Goerdt, an acquaintance, came to her residence unexpectedly. She invited him in and they talked. Later, they began kissing consensually but Goerdt made other advances and the victim told him to stop. Goerdt then got on top of her and told her he was a predator. She asked him to stop about 15 times during the assault but Goerdt was not deterred.
Eventually the victim was able to push Goerdt away and at that point he stopped, said Palhegyi.
During an interview, Goerdt claimed he did not commit the assault because his pants were too tight to unbutton his fly.
Goerdt was charged with sexual assault. His bail was listed at $150,000.
