ELKO – A jury trial started Tuesday for an Elko woman accused of child abuse that also involved her husband.
Brandi Gallegos, 30, is charged with abuse or neglect of a child with substantial bodily harm and child abuse resulting in substantial bodily harm committed by a person responsible for the safety or welfare of a child.
Additionally, she was charged with two lesser counts of abuse or neglect. All are category B felonies.
A person convicted on the higher charges could receive up to 20 years in prison for each count.
According to court records and testimony, the case goes back to April 2014 when an Elko Police Department officer received a call from the Department of Child and Family Services regarding the physical condition of the Gallegos’ son, who was about 2 years old at the time, and visited the home.
Gallegos was arrested with her husband, Brett Gallegos, on May 3, 2016 at their home. She pleaded not guilty in Elko District Court Department 1 before Judge Nancy Porter on Sept. 19, 2016.
Brett Gallegos pleaded guilty to one count of child abuse perpetrated by neglect or endangerment of a child, a gross misdemeanor. On Aug. 24, he was given a suspended sentence of 364 days in jail and placed on probation for three years by Porter.
Gallegos is represented by attorney Gary Woodbury. The trial is expected to last through next week.
